The commission must appoint in the case of any election for the president or members of the National Assembly, for each constituency and for the polling stations outside Namibia jointly; for any member of a regional council, for a constituency; for members of a local authority council, for a local authority area:

A returning officer who has, subject to the direction and supervision of the chief electoral officer, the powers and functions as may be conferred or imposed on him or her by or under this Act, and such additional returning officers or assistant returning officers for a constituency or a local authority area as the Commission may determine; (b) as counting officers the number of persons as it may deem necessary for the purpose of assisting any person who, in terms of this Act, is charged with the counting of votes at a polling station; (c) a presiding officer for each polling station who is in control thereof. The commission must ensure that the various officers appointed under are well trained and have passed the numeracy, literacy and eligibility tests determined by the commission.
