Trainee doctor guilty of rape
A trainee doctor who was accused of raping a patient with a brain injury in April 2021 in a Windhoek hospital was found guilty yesterday.
The incident took place on 11 April 2021 in the Katutura Intermediate Hospital, where Dennis Noa worked as a medical intern.
Magistrate Victor Nyazo found Noa (29) guilty yesterday, two months after state prosecutor Palmer Khumalo and Noa's representative, James Diedericks, delivered closing arguments in the trial.
The State argued that the 18-year-old male patient, who was treated at the hospital's head injury unit, was unconscious and incapacitated due to a severe head injury when Noa raped him.
Noa pleaded not guilty at the start of his trial in April last year. He was further acquitted on a charge of attempted murder after the State closed its case.
According to the evidence brought before the court, Noa pushed the patient's bed into a conference room on the morning of the incident.
After he later returned the patient to his room, a physical therapist - who was set to work with the patient - reported finding an unused condom next to the patient on his bed and seeing a liquid in the patient's anal area.
During his closing arguments, Diedericks argued that there was not enough evidence to prove that the patient had indeed been raped. He also pointed out that although there was a forensic investigation, the State chose to withhold its results from the court.
A date has not yet been scheduled for the delivery of pre-sentencing arguments.
