Riruako mourns loss of Commando 2
Hoze Riruako, who leads a faction of the Ovaherero Traditional Authority, has described the loss of a portion of land to the Herero Royal Red Flag Association (HRRFA) as a huge loss.
Speaking on behalf of the Herero Red Flag Regiment (HRFR), which had claimed ownership of the land on which Commando Hall Number 2 is situated, Riruako said the High Court erred in a decision to rule that the HRRFA was the rightful owner of the land.
He made the remarks during a community meeting held at Commando Number 1 in Okahandja, following the judgment made by Judge Claudia Claasen.
“We have been robbed of something so precious that our ancestors and we worked to bring to existence - an investment that we superbly maintained for years. Millions of dollars, our toils, sweat and hard work and that of our ancestors have gone down the drain,” he said.
He further called for calm among his subjects, saying it was not worth fighting the HRRFA over the court’s decision.
Riruako added that his faction would respect the judgment and abide by the law.
“The HRFR respects the judgment of both the High Court and the Supreme Court in this dispute concerning Commando Number 2. I must, however, attest to the fact that it is the wrong decision purported by the correct legal technicalities,” he said.
Origin of dispute
Documentary evidence shows that the City of Windhoek agreed in 2000 to sell Erf 6297 in Katutura to the HRRFA, and that a sale agreement between the municipality and the association was signed in May 2000, Claasen noted.
However, in documents in which the City instructed a law firm to carry out the transfer of the property, a line was drawn through the word ‘Royal’ in the buyer’s name, and after that, a deed of transfer executed in December 2009 reflected the HRFA, and not the HRRFA, as the new owner of the property, leading to the despite.
“There was no agreement, no resolution or any sound basis as to why the property was to be transferred to anyone other than the [HRRFA],” Claasen said.
