#NamSunNews Boulter fails in court application against AG
British billionaire, Harvey Boulter, has failed in his attempt to have the decision to charge him for murder set aside.
Judge Herman Oosthuizen dismissed his application this morning in the High Court in Windhoek.
Boulter challenged the decision of the Prosecutor-General, Martha Imalwa, to prosecute him with murder.
In his application, Boulter claimed that there was no evidence that he intentionally shot his farm worker, Gerhard van Wyk, in February 2021. He argued that the shot was fired during a scuffle as Van Wyk was trying to take Boulter's 9mm pistol from him.
However, Imalwa maintained that she acted reasonably in her decision and there were sufficient facts from which a reasonable person could infer that Boulter committed the crime he is accused of.
