N$1.25 million lawsuit over street assault

In November last year, a video was circulated on social media platforms showing a man kicking and hitting another man on a street in Windhoek.

The man depicted on the ground during the altercation, Waldo Beukes, has now filed a N$1.25 million lawsuit at the Windhoek High Court against the man who allegedly assaulted him, Hugo Arangies.

Beukes alleges that Arangies punched him several times, kicked him in the face and threw him onto the sidewalk.

According to Beukes' claim, filed in February, he sustained multiple injuries during the incident. He reportedly dislocated his shoulder, broke his arm and incurred cuts on his face and body, as well as a concussion.

The incident occurred on 20 November in Andimba Toivo ya Toivo Street.

Aftermath of public attack

In Beukes' claim, he alleges that Arangies acted unlawfully, improperly and intentionally with the aim of causing him serious harm. In addition to his physical injuries, Beukes argues that the incident has humiliated him and infringed upon his dignity, reputation and self-confidence.

Beukes claimed he was subjected to public humiliation since the incident occurred in front of members of the public and the video was widely circulated on social media.

"Several friends and family called him [Beukes] and asked about the assault. "He will no longer be able to socialise and communicate with others with the same level of confidence he had before the assault," his claim details state.

Beukes is asking the court to award him N$500 000 for the pain and suffering he allegedly endured as a result of the incident, an additional N$500 000 for the damage to his reputation due to the alleged public humiliation, and another N$250 000 for the emotional shock and trauma he claims to have experienced.

Although Arangies and his attorney have indicated that they will oppose the case, no pleadings have been filed yet.

According to a recent court order, Arangies must file by 18 April.

The case has been postponed to 6 June for mediation facilitated by the court.
